O quadro institucional brasileiro - notadamente o Código Florestal, a Lei da Política Nacional do Meio Ambiente e a Constituição Federal - assegura que as florestas são bens de interesse comum a todos os habitantes do país. Nesse contexto, este trabalho discorre sobre as funções típicas de Estado na área florestal, com vistas a garantir os benefícios coletivos provenientes dos recursos florestais. Exemplos são apresentados para cada função, quando disponíveis.

The Brazilian institucional framework – especially the Forest Code, the Law of the Environment and the Federal Constitution - assures that the forests are good of common interest to all the inhabitants of the country. In this context, this work discourses on the typical functions of State in the forest area, with sights to guarantee the collective benefits proceeding from the forest features. Examples are presented for each function, when available.
